Foresum is a marketplace platform intended to facilitate transactions involving golf-related collectibles, equipment, apparel, accessories, and related items. Foresum’s focus is to provide structured transaction tools, verification processes, and marketplace standards intended to reduce transaction risk before payment occurs. Foresum is not a manufacturer, distributor, or owner of most items listed on the Platform.

You must:

• Be at least 18 years old;
• Be legally capable of entering into binding agreements;
• Use the Platform only in compliance with applicable laws.

Foresum currently operates within the United States only.

Users may be required to create an account to access certain Platform features. You agree to:

• Provide accurate information;
• Maintain current account information;
• Protect account credentials;
• Accept responsibility for all activity occurring under your account.

Foresum reserves the right to suspend or terminate accounts at its discretion for conduct that violates these Terms or undermines marketplace integrity.

Users are solely responsible for:

• The accuracy of listings;
• Ownership of listed items;
• Compliance with applicable laws;
• Transaction communications;
• Shipment and fulfillment obligations.

All listings must:

• Accurately describe item condition;
• Include truthful photographs;
• Disclose known modifications or defects;
• Avoid misleading or deceptive representations.

Foresum may remove listings that violate these Terms or marketplace standards.

Foresum may provide verification, authentication, moderation, review, or transaction-support processes. These processes are intended to reduce transaction uncertainty, but:

• No verification process is infallible;
• Foresum does not guarantee authenticity of every item;
• Users remain responsible for exercising independent judgment before completing transactions.

Authentication opinions or verification results are provided in good faith based on available information at the time of review.

Users may not:

• Sell counterfeit or stolen goods;
• Misrepresent item authenticity or condition;
• Use fraudulent payment methods;
• Manipulate pricing or transactions;
• Harass or threaten other users;
• Circumvent marketplace safeguards or verification processes;
• Use the Platform for unlawful purposes.

Foresum reserves the right to remove content, suspend users, or report unlawful conduct.

Foresum may facilitate or support payments through third-party providers. Users acknowledge:

• Payment processors operate independently from Foresum;
• Payment disputes may involve third-party review processes;
• Foresum may not control external payment provider decisions.

Users are responsible for reviewing the terms of any payment processor used in connection with transactions.

Foresum may charge transaction fees, seller fees, authentication fees, shipping fees, or service fees. Applicable fees will be disclosed before completion of relevant transactions. Foresum reserves the right to modify fees at any time.

All Platform content, branding, software, workflows, graphics, logos, designs, systems, and related materials are the property of Foresum Limited, LLC or its licensors. Users may not:

• Copy;
• Reproduce;
• Reverse engineer;
• Modify;
• Distribute;
• Commercially exploit;

any portion of the Platform without prior written permission.

Users retain ownership of content they submit, including listings, photographs, reviews, and messages. By submitting content, users grant Foresum a non-exclusive, worldwide, royalty-free license to:

• Display;
• Reproduce;
• Modify for formatting;
• Promote;
• Distribute;

such content in connection with operation of the Platform. Users represent that they possess necessary rights to submitted content.

Users acknowledge that all marketplace transactions involve inherent risk. While Foresum is designed to reduce transaction uncertainty through structured processes, users understand that:

• Disputes may still occur;
• Authenticity concerns may arise;
• Shipping issues may happen;
• Third-party misconduct cannot be entirely eliminated.

Participation on the Platform is voluntary and at the user’s own risk.

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORESUM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• MERCHANTABILITY;
• FITNESS FOR A PARTICULAR PURPOSE;
• NON-INFRINGEMENT;
• ACCURACY;
• RELIABILITY;
• CONTINUOUS AVAILABILITY.

FORESUM DOES NOT GUARANTEE:

• UNINTERRUPTED PLATFORM ACCESS;
• ERROR-FREE OPERATION;
• SUCCESSFUL TRANSACTIONS;
• ITEM AUTHENTICITY;
• USER PERFORMANCE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORESUM LIMITED, LLC SHALL NOT BE LIABLE FOR:

• INDIRECT DAMAGES;
• INCIDENTAL DAMAGES;
• CONSEQUENTIAL DAMAGES;
• LOST PROFITS;
• LOST DATA;
• REPUTATIONAL HARM;
• TRANSACTION DISPUTES BETWEEN USERS.

FORESUM’S TOTAL LIABILITY ARISING FROM PLATFORM USE SHALL NOT EXCEED THE GREATER OF:

• THE AMOUNT PAID TO FORESUM BY THE USER IN THE PREVIOUS 12 MONTHS; OR
• $100 USD.

Users agree to indemnify and hold harmless Foresum Limited, LLC, its officers, employees, contractors, and affiliates from claims arising out of:

• User conduct;
• User listings;
• Violations of these Terms;
• Violations of applicable law;
• Intellectual property disputes.

Foresum may suspend or terminate access to the Platform at any time for:

• Violations of these Terms;
• Fraudulent conduct;
• Conduct that undermines marketplace trust or safety.

Users may discontinue use of the Platform at any time.

These Terms shall be governed by the laws of the State of Colorado, without regard to conflict of law principles. Any legal action arising under these Terms shall be brought in the courts located within Colorado.

Foresum may update these Terms periodically. Continued use of the Platform after changes become effective constitutes acceptance of revised Terms.

Foresum is not a law enforcement agency, escrow institution, financial institution, or official certification authority unless expressly stated otherwise.

Any authentication review, verification process, moderation action, or transaction-related guidance provided by Foresum is based on available information at the time of review and should not be interpreted as an absolute guarantee of authenticity, condition, ownership, legality, or transaction outcome.

Users remain solely responsible for:

• Conducting independent due diligence;
• Reviewing item details;
• Verifying transaction information;
• Selecting payment methods;
• Evaluating transaction risk.

Foresum does not guarantee:

• That every listed item is authentic;
• That transactions will complete successfully;
• That users will comply with agreements;
• That disputes will not arise.

Marketplace participation inherently involves risk. Foresum’s processes are designed to reduce transaction uncertainty before payment occurs, but no marketplace system can eliminate all potential fraud, error, misconduct, or dispute.

To the maximum extent permitted by law, Foresum disclaims liability for:

• User misconduct;
• Counterfeit goods;
• Shipping losses;
• Payment disputes;
• Third-party actions;
• Financial losses arising from marketplace activity.

By using the Platform, users acknowledge and accept these risks. Users should seek independent legal, financial, tax, or professional advice when appropriate.
